ORDER

Petitioner has come forward with the present petition seeking a direction to the sixth respondent to register a case on the petitioner's complaint dated 13.07.2011.

2. The case of the petitioner is that he is the retired staff of Tamil Nadu Agricultural University, Coimbatore. The https://hcservices.ecourts.gov.in/hcservices/

petitioner, on seeing an advertisement from one M/s. Green Home Landscape P. Ltd., for purchasing a plot, had entered in to an agreement with the proprietor one Mr.Anandan for total consideration of Rs.2,50,000/- and had agreed to pay an advance amount of Rs.20,000/- and also agreed to pay the balance amount in 59 equal monthly instalments @ Rs.2500/- per month. The petitioner had also paid 56 instalments and when he tried to pay the balance 3 instalments, the said Anandan refused to receive the same and also decline to register the sale deed as assured by him. Hence, a complaint had been lodged before the sixth respondent. Since no action had been taken by the respondent police, the petitioner is before this Court.

3. Learned Additional Public Prosecutor submits that already a complaint was registered as against the said M/s.Green Home Landscape P. Ltd., in Crime No.60 of 2011 based on the complaint lodged by one Shri Sharma and the petitioner will be added as a witness in the said complaint.

4. Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is closed. However, petitioner is directed to co-operate for the enquiry with regard to the complaint lodged by him with the fifth respondent.
