C.M.P.Nos.11726, 11728 & 11729 of 2022 in C.R.P.No.609 of 2018 N.SATHISH KUMAR, J These applications have been filed to condone the delay of 920 days in filing the petition to bring the legal representatives of the deceased first respondent; to set aside the abatement caused due to the death of the first respondent/plaintiff,namely, Ponnammal and to bring on record the legal representatives of the deceased first respondent/plaintiff, viz., Kalaiselvi, Saroja and Kannagi as respondents 5 to 6 in the above Civil Revision.

2. According to the petitioner, the sole plaintiff/first respondent died on 15.08.2018 and the respondents 5 to 7 are the legal representatives of the deceased sole plaintiff/first respondent. However, the same was informed to their counsel only on 26.06.2021 and hence, the delay in filing these petitions.

3. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, this court is of the view that unless the legal heirs are brought on record, substantial rights of the parties to advance the arguments on merits will be affected and hence, the delay is condoned and all the Civil Miscellaneous Petitions are allowed.

4. Registry is directed to carry out necessary amendment in the Civil Revision Petition and list the CRP on 09.07.2025 for arguments. 02.07.2025 mrp https://www.mhc.tn.gov.in/judis
