C.M.P.No.13145, 13149 & 13152 of 2021 in S.A.No.997 of 2010 C.V.KARTHIKEYAN, J.

These petitions have been filed seeking to condone the delay of 923 days in filing petition to set aside abatement consequent to the death of the 4th appellant, to set aside abatement and to bring on record her legal representative as the 6th to 9th appellant.

2.It is contended that the 3rd appellant had died and the legal representative of the 3rd respondent is already on record as the 5th appellant. With respect to the 4th appellant, the proposed legal representatives have been impleaded as Appellant Nos.6 to 9. In filing these petitions, there has been delay in bring them on record. 3.The Second Appeal has not yet been admitted. To give an opportunity to the counsel to argue the appeal on admission, these petitions are allowed. 4.The Registry to carry out necessary amendment reflecting the death of the 3rd and 4th appellants and recognize the 5th appellant as the legal representative of the 3rd appellant and bring on record the 6th to 9th appellants as legal representatives of the 4th appellant.
