Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the first and second respondent to consider representation dated 23.05.2012 and to take action against it and thereby issue patta for the property in survey number 1257/5 measuring an extent of five cents situated at 36/10, Acharapakkam Road, Maduranthagam. Mr.A.Kumar, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner seeks for a mandamus directing the first and second respondents to consider his representation dated 23.05.2012, wherein and whereby he sought for issuance of patta in respect of the property in Survey Number 1257/5, situated at 36/10, Acharapakkam Road, Maduranthagam, measuring to an extent of 5 cents.

4. The grievance of the petitioner before this Court, is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the second respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the second respondent to consider the representation of the petitioner dated 23.05.2012 and pass orders on the same on merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as the rival claimants, if any. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs. Mk Sd/- Asst.Registrar /true copy/ Sub Asst.
