The present criminal original petition has been filed seeking a direction to the 2nd respondent Police to register the petitioner's complaint dated 28.07.2015 and investigate the same in accordance with law.

2. The petitioner herein lodged a complaint as against one Thiyagarajan alleging that the said Thiyagarajan along with his henchmen trespassed into the house of the petitioner and threatened the petitioner with dire consequences. Though the said complaint was given on 28.07.2015, till date no action was taken. Hence, the petitioner has filed the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. Today, when the matter is taken up for consideration, the learned Additional Public Prosecutor submitted that on the same set of allegations, the petitioner's husband earlier lodged a complaint and on enquiry, the said complaint was closed. Therefore, the question of conducting enquiry on the same set of allegation does not arise. Thus, he opposed the prayer of the petitioner.

5. Since the earlier complaint given by the petitioner's husband was closed, this Court is not inclined to give any further direction to the respondent to register the complaint. Hence, recording the submission of the learned Additional Public Prosecutor, the present criminal original petition is dismissed.
