Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to pass an appropriate order or direction, directing the respondents 1 & 2, to transfer the case in Crime No.139 of 2021 on the file of the third respondent Police, to any other competent authority to investigate the case in fair and speedy manner and to file final report within a time limit to be fixed by this Court.

O R D E R

This Criminal Original Petition has been filed seeking transfer of investigation in Crime No.139 of 2021 from the file of the third respondent to any other investigating agency.

2. On instructions, the learned Government Advocate (Crl.Side) appearing for the respondents submitted that an FIR has been registered in Crime No.139 of 2021 for the offences under Sections 406, 420 and 506(i) of IPC as against the accused. He further submitted that the entire investigation has been completed and a final report is ready to be filed.

3. In view of the above, at this stage, transferring the investigation to any other investigating agency would affect the investigation already conducted by the third respondent. However, the third respondent is directed to complete the investigation and file a final report within a period of four weeks from the date of receipt of a copy of

this order. The second respondent is directed to monitor the investigation conducted by third respondent.

4. In the result, this Criminal Original Petition stands dismissed with the above direction.
