Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition of deposit a sum of Rs.50,00,000/- (Rupees Fifty lakh only) to the credit of Cr.No.186/2021 as ordered in Crl.OP.No.10926/2021 on 13.07.2021 in to any other lesser condition and pass such other or other orders.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.PUSHPAKARAN, Advocate for the petitioner, and of Mr.L.BASKARAN, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the conditional order imposed by this court in Crl.O.P.No.10926 of 2021, dated 13.07.2021 to deposit a sum of Rs.50,00,000/- to the credit of Cr.No.186/2021.
2. Earlier, bail was granted to the petitioner with a condition to deposit a sum of Rs.50,00,000/-. Now, seeking modification of the said condition, the present petition has been filed.
3. The learned counsel appearing for the petitioner submitted that the petitioner has maintained seven bank accounts in the Axis Bank, including his wife's account and the Investigating Agencies had frozen all the bank accounts. He further submitted that the a
total sum of Rs.31,00,000/-(Rupees Thirty One Lakhs only) is lying in the above bank accounts. Hence, the petitioner is ready and willing to pay the balance sum of Rs.20,00,000/-(Rupees Twenty Lakhs only).
4. Considering the fact that the a sum of Rs.31,00,000/- is secured by way of freezing the account of the petitioner and his wife, this court is inclined to modify the condition.
5. Accordingly, the petitioner is directed to deposit a sum of Rs.20,00,000/- (Rupees twenty lakhs) to the credit of Crime No.186 of 2021, within four weeks from the date of receipt of a copy of this order.
As far as the other conditions imposed in Crl.O.P.No.10926 of 2021 dated 13.07.2021 are concerned, it shall continue.
6. Accordingly, this petition is ordered.
