ORDER
Heard.
This writ petition has been filed, praying that this Court may be pleased to issue a Writ of Mandamus, to direct the third respondent to consider and pass orders, on the representation of the petitioner, dated 24.8.2015.
It has been stated that the representation of the petitioner, dated 24.8.2015, relates to the cancellation of the pattas issued to various persons, in respect of the land, in S.No.654/4A, at Mookkondappalli Village, Hosur Taluk, At this stage of the hearing of the writ petition, the learned counsel appearing for the fifth respondent had submitted that the petitioner has filed a civil suit, on the file of the District Munsif Court, Hosur, in O.S.No.9 of 2013, praying for a decree of declaration of title and for permanent injunction. This Court had passed an order, dated 4.10.2013, in W.P.No.21968 of 2013, directing the District Munsif, Hosur, to dispose of the suit, filed by the petitioner, in O.S.No.9 of 2013. While so, the petitioner has preferred the present writ petition before this Court. The writ petition filed by the petitioner is devoid of merits and premature in nature and the same is liable to be dismissed, in limine.
Accepting the said submission made by the learned counsel appearing on behalf of the fifth respondent, this Court is of the view that the writ petition is not maintainable, at this stage. Therefore, the writ petition is dismissed. No costs. However, it goes without saying that it may be open to the petitioner to seek her remedies, if any, before the appropriate civil court, if so advised.
