The petitioner, who was arrested and remanded to judicial custody on 17.08.2023 in Crime No.308 of 2023 registered for the alleged offences punishable under Sections 379 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner prayed for bail stating that this is the second bail application filed by the petitioner before this Court and the same was dismissed on 12.09.2023. He also submitted that the petitioner is aged about 30 years and he has nothing to do with the alleged offence. He further submitted that the co-accused /A2 has been released on bail by this Court dated 16.04.2024. He also submitted that the petitioner is in custody from 17.08.2023.

Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that on 14.07.2023 at about 3.00 p.m, when defacto complainant has brought his daughter from school in Sriraman Road, three persons came in two-wheeler and snatched 5 sovereigns of thali chain of the defacto complainant. He further submitted that this petitioner / A3 was hails from Rajasthan. He further submitted that the petitioner has one previous case pending against him. He further submitted that if he is released on bail, he would hamper the investigation and tamper the witnesses and the investigation is still pending and thereby, there is

no change of circumstances. Hence, he opposed for the grant of anticipatory bail to the petitioner.

4. Heard both sides and perused the materials available on record.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is still pending and also considering the fact that the earlier bail application was dismissed and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. 03.06.2024 drl
