This petition is filed to condone the delay of 397 days in filing the appeal.

Heard Mr.T.S.Arthanareeswaran, learned counsel for the petitioners.

There are two respondents in the present petition, out of which, the first respondent, since has already been set ex parte before the Tribunal, the learned counsel for the petitioner wants to give up the first respondent, as he is not the main contesting respondent.

The second respondent has already been served and Mr.R.Premchander, learned counsel, represents the second respondent.

Though the learned counsel appearing for the second respondent opposed this petition, having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 397 days in filing the appeal is condoned. Accordingly, the petition stands ordered.
