Mr.C.Selvaraj Additional Government Pleader (in 2WPs) COMMON ORDER The writ petition in W.P.No.17803 of 2025 has been filed against the impugned order dated 28.01.2025, wherein the Commissioner, Municipality Office, Kallakurichi, has rejected the petitioner's claim for earned leave salary and unearned leave salary on account of pendency of the present writ petition.
2. Another writ petition in W.P.No.17731 of 2025 has been filed
challenging the charge memorandum issued against the petitioner dated 29.09.2023.
3. The learned counsel for the petitioner would submit that the petitioner joined as a Junior Assistant in the respondent Thiruvathipuram Municipality in 1986 and was permitted to retire as Assistant Revenue Officer on 30.09.2023, without prejudice to the disciplinary proceedings. Despite retiring on 30.09.2023, the earned leave salary and unearned leave salary were not disbursed by the respondents. Hence, he has sent representation to the respondents, which was rejected solely due to the pendency of disciplinary proceedings.
4. The learned Additional Government Pleader appearing on behalf of the respondents would submit that a charge memo has been issued against the petitioner for causing a loss of Rs.77,17,736, which is impugned in the writ petition in W.P.No.17731 of 2025.
5. When there is a grave charge against the petitioner for causing loss of Rs.77,17,736/-, this Court finds no merits to interfere with the impugned order dated 28.01.2025. However, considering the long pendency of the disciplinary proceedings since 2023, this Court deemed it appropriate to direct the Disciplinary Authorities to conclude the disciplinary proceedings within a period of six (6) months from the date of receipt of a copy of this order.
6. With the above directions, the Writ Petitions stand disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 05-06-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes Jeni
