O R D E R
(The case has been heard through video conference) The petitioners, who were arrested and remanded to judicial custody on 16.08.2020 for the offences punishable under Section 392 IPC, in Crime No.2598 of 2020, on the file of the respondent police, seek bail.
2.The case of the prosecution as per the defacto complainant one Manikandan is that on 16.08.2020 while he was coming along with his wife towards Melvanakampadi Mariamman Koil in his motor cycle, the petitioners who had come in a motor cycle snatched the gold mangal sutra worn by the wife of the defacto complainant. When the defacto complainant and his wife raised alarm, the villagers around caught hold of the accused on the same spot red handedly. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case for statistical purpose. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Criminal Side) would vehemently oppose stating that it is a case where the petitioners in broad daylight attempted to snatch the gold mangal sutra worn by the wife of the defacto complainant.
Fortunately, the defacto complainant raised alarm and the people around caught hold of the petitioners at the scene of occurrence. He would further submit that as far as the 1st petitioner is concerned he has got one previous case.
5.Taking into consideration of the fact that the petitioners have attempted to snatch the gold mangal sutra of the defacto complainant's wife in broad daylight and were caught red handed by the villagers and also considering the fact that the petitioners were arrested very recently on 16.08.2020, this Court is not inclined to grant bail to the petitioners.
6.This Criminal Original Petition petition stands dismissed accordingly.
