ORDER

This Criminal Original Petition has been filed to direct the 2nd respondent Police not to harass the petitioner under the guise of enquiry.

2.The petitioner was called for an enquiry on 23.03.2026 on the complaint lodged by the 3rd respondent. The petitioner states that he has given his explanation stating that it is purely a civil dispute. However, the petitioner was forced to give an undertaking that he will appear on future dates also on the call of the Police. Hence, apprehending harassment at the hands of the Police, the petitioner has filed this petition.

3.Learned Government Counsel (Criminal Side) appearing for the respondent Police submitted that the 3rd respondent had given a complaint against the petitioner and for the purpose of enquiry, they were summoned and they had appeared on 23.03.2026 and enquiry is pending. In any event, if the petitioner is required for further enquiry, he would be called only by way of summons.

4.Recording the submissions made by the learned Government Counsel (Criminal Side) appearing for the respondent Police, this Criminal Original Petition is disposed of. It is made clear that, under the guise of enquiry, the petitioner shall not be unnecessarily harassed by calling at odd hours or at short intervals or without summons.
