O R D E R
(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 21.08.2020 for the offences punishable under Section 489(B), 489(C) of IPC, in Crime No.1209 of 2020, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused was found in possession of 56 nos. of counterfeit notes of Rs.500/- denomination. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he is a resident of Madurai. Infact, the petitioner had gone to Tiruppur for employment and that he has been falsely implicated in this case. He would further submit that the petitioner was arrested on 21.08.2020 and he has been suffering incarceration for more than 30 days. Hence, he seeks for grant of bail to the petitioner.
4.The learned Government Advocate (Crl. Side) appearing for the respondent would vehemently oppose stating that the petitioner along with other accused was found in possession of 56 numbers of counterfeit notes of Rs.500/- denomination. He would further submit that there are two accused in this case and the petitioner is arrayed as A2 and there is no previous case against him. Insofar as A1 is concerned, there are three previous cases against him. He would further submit that the petitioner was arrested recently on 21.08.2020 and that the investigation is at the nascent stage. https://hcservices.ecourts.gov.in/hcservices/
5. Taking in to consideration the nature of offence and the fact that the petitioner was arrested recently on 21.08.2020 and that the investigation is at the nascent stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
