Mr.S.Soundararajan, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a Mandamus, directing the second respondent to pass orders on his representation dated 02.01.2018, wherein and whereby, he sought for rectification of classification of the land comprised in Survey Nos.177/9 & 177/10 as Vaari.
3. It is seen from the proceedings of the Assistant Director, District Survey Office, Ariyarlur, dated 04.01.2018, that the petitioner has to approach the Revenue Divisional Officer and make such request for rectification of classification of the subject matter land. It is stated by the petitioner that on 02.01.2018, the petitioner has already made a representation to the District Collector and other officials, including the Revenue Divisional Officer, Udayarpalayam, Ariyalur District, seeking for rectification of classification of the land. It is stated that the said representation has not been considered so far.
4. Therefore, this Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the said official namely the Revenue Divisional Officer, Udayarpalayam, Ariyalur District to consider the request of the petitioner and pass orders on the same on merits and in accordance with law. Even though the said official has not made as a party in this writ petition, since the representation has already made to him, the said official namely, Revenue Divisional Officer, Udayarpalayam, Ariyalur District is directed to consider the claim of the petitioner and pass orders on merits and in accordance with law, as expeditiously as possible. The Registry is directed to mark a copy of this order to the Revenue Divisional Officer, Udayarpalayam, Ariyalur District.
5. With the above observation, this writ petition is disposed of. No costs.
