O R D E R
This petition has been filed to direct the respondent police to enquire, investigate and register a case based on the complaint given by the petitioner dated 10.01.2015 within the stipulated time as may be fixed by this Court.
2. The petitioner herein lodged a complaint stating that on 10.01.2015 at about 11.30 a.m. one viz., V.G.B.Sivaram Prasad, T.Mohan, V.Rahda Narasimha Rao along with rowdy elements criminally trespassed into the petitioner's residence situated at Sri Krishna Apartments, No.39/6, Thanikachalam Road, T.Nagar, Chennai - 600 017, and threatened him with dire consequences . Though the complaint was lodged on 10.01.2015, till date no action has been taken. Hence, this petition.
3. Heard the leaned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. https://hcservices.ecourts.gov.in/hcservices/
4. Learned Additional Public Prosecutor submitted that the petitioner has given a complaint through post and if a complaint is given in person, necessary action will be taken.
5. Considering the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the respondent police, in person, along with a copy of this order within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the respondent police is directed to enquire into the matter and if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible. In the course of enquiry, if no prima facie is made out or the matter is civil in nature, he is directed to pass appropriate orders on the complaint made by the petitioner.
6. The criminal original petition is disposed of accordingly.
