Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to dispose the petitioner's statutory appeal dated 16.09.2016 which is pending on the file of the 2nd respondent within a stipulated period of time and in accordance with law pursuant to the enquiry proceedings in Na.Ka.543/2016/B2 dated 27.01.2017 initiated by the 2nd respondent.

Mr.A.Kumar, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed seeking for a direction to the second respondent to dispose the appeal preferred by the petitioner before the second respondent in respect of patta proceedings.

3. The grievance of the petitioner is that the said appeal has not been disposed of so far, even though an enquiry notice was issued on 27.01.2017.

4. Therefore, this writ petition is disposed of, without expressing any view on the merits of the claim made by the petitioner, only with a direction to the second respondent to dispose of the appeal filed by the petitioner on its own merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as other interested persons / rival claimants, if any. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
