These civil miscellaneous petitions have been filed (a) to condone the delay of 398 days in filing the petition to set aside the abatement caused due to the death of the first respondent, (b) to set aside the abatement caused due to the death of the first respondent and (c) to bring on record the legal representatives of the deceased first respondent in the main civil miscellaneous appeal.

2. This Court is satisfied with the reasons stated in the affidavit filed in support of these petitions.

3. Accordingly, these civil miscellaneous petitions are allowed as prayed for without prejudice to the rights and contentions of the respondents.
