ORDER

The petitioner was appointed as Computer Assistant in Rural Development Office, Kamuthi on 19.6.08. On the allegation that he had addressed an e-mail to the higher officials abusing and criticising the manner in which the work is done thereby preventing them from discharging their duties, a FIR was registered against the petitioner. The petitioner, apprehending arrest, moved anticipatory bail petition before the Madurai Bench of the Madras High Court in Crl. O.P. No.21409 of 2009. Considering the merits of the case, the petitioner was granted anticipatory bail.

2. In the meanwhile, the Collector conducted an enquiry on 5.11.16 and after completion of the enquiry, the petitioner was dismissed from service on 30.6.17. Against the said order, an appeal has been filed by the petitioner before the 1st respondent on 4.7.17, which is pending for adjudication. As the petitioner is the sole bread winner in the family and the appeal filed https://hcservices.ecourts.gov.in/hcservices/

against the order of dismissal having not been dealt with till date, the present petition has been filed for a direction to dispose of the appeal filed by the petitioner on merits as expeditiously as possible.

2. Heard the learned counsel appearing for the petitioner and the learned Addl. Government Pleader appearing for the respondents.

3. In the above factual background, this Court is of the considered opinion that it would be suffice to direct the respondents to consider the appeal filed by the petitioner and pass orders thereon on merits and in accordance with law within a time frame.

4. Accordingly, the 1st respondent is hereby directed to consider the appeal filed by the petitioner against the order of dismissal passed by the 2nd respondent and pass orders thereon on the same on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

5. This writ petition is disposed of with the aforesaid observation and direction. However, in the circumstances of the case, there shall be no order as to costs.
