ORDER

The petitioner apprehends arrest for the alleged offence under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) of BNS r/w Section 4 of TNPHW Act, 2002 in Crime No.40 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 15.03.2026, during a family function at Santhapettai Community Hall, A1 along with four others picked up a quarrel with the defacto complainant's wife, abused her in filthy language, attacked her with red bricks causing injuries, and threatened with dire consequences. Hence, the complaint.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submitted that the petitioner has been wrongly roped in merely on account of his alleged association with a history sheeter. Hence, he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that the injured has been discharged from the hospital. He further submitted that if the petitioner is enlarged on bail, it may embolden him to commit similar offences. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the totality of the circumstances of the cases, this Court is

of the view that the petitioner, who is alleged to have been involved in the occurrence along with a history-sheeter and in a function where he was not invited, this petitioner does not deserve anticipatory bail.
