The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) 20(b)(ii)(B) of NDPS Act, 1985, in Crime No.562 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was in possession of 1.100 kgs of Ganja. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner was in possession of 1.100 kgs of Ganja. He would

further submit that there are four previous cases pending against the petitioner which are similar in nature. He would further submit that the earlier anticipatory bail petition filed by the petitioner was dismissed by this Court in Crl.O.P.No.7012 of 2023 dated 18.04.2023. Now, the second petition has been filed by the petitioner suppressing the earlier dismissal order of this Court and that there is no change of circumstances. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner

5. Taking into account the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 09.06.2023 jas
