ORDER
(Made by M. SUNDAR,J.) Prayer in the captioned 'writ petition' (hereinafter 'WP' for the sake of brevity) is for cancellation of patta said to have been issued in favour of R4 (Khaja Mohideen).
2. Learned State counsel draws our attention to Section 12 of 'the Tamil Nadu Patta Pass Book Act, 1983' (hereinafter referred to as 'said Act' for the sake of brevity and convenience) and submits that a mechanism has been put in place and a procedure has been drawn up for seeking cancellation of patta. Learned State counsel adds that this mechanism also provides for the patta holder being put on notice and given an opportunity.
3. In the light of the above submission of learned State counsel, suffice to write that the writ petitioner has to take recourse to said Act and seek cancellation of patta. This also means that the mandamus prayer is not acceded to but we preserve the rights and contentions of the writ petitioner as well as
R4 and any other person(s) concerned with the matter, if proceedings for cancellation of patta are commenced.
