Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the first respondent to conduct the enquiry in complaint made by the petitioner on 26.08.2015 and also to complete the investigation and file a final report accordingly within the time stipulated by this Hon'ble Court before the concerned Court. ORDER

This petition is filed for a direction to the first respondent to conduct the enquiry in the complaint made by the petitioner on 26.08.2015 and also to complete the investigation and file a final report within the time stipulated by this Court. 2.In the petition it is stated that the third respondent is having man and money power in the village and she is frequently threatening the petitioner. It is further stated that the third respondent is doing travels business, real estate business by way of immoral and illegal activities and she has also obtained many properties at lower rate from the poor people. It is also further stated that the third respondent is also not paying the income tax and hence, the petitioner lodged a complaint before the respondent on 26.08.2015, but till date no action was taken. Hence, this petition.

3.Today when the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that the allegations do not fall within the purview of the respondent police to investigate the matter and thus, he opposed the prayer. 4.Considering the allegations made in the complaint and in view of the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to direct the first respondent police to conduct investigation and hence, this Criminal Original Petition is dismissed.
