Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed by this Hon'ble Court in order dated 11.07.2017 in Crl.M.P.No.813/2017 in Crl.A.No.33 of 2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.G.MAGESH KUMAR, Advocate for the petitioner and of MR. V.ARUL, ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition has been filed seeking relaxation of the condition imposed on the petitioner in Crl.M.P.No.813 of 2017 in Crl.A.No.33 of 2017 under orders dated 11.07.2017.
2. This Court, under orders dated 11.07.2017 in M.P.No.813 of 2017 in Crl.A.No.33 of 2017, while suspending the sentence imposed on petitioner, has required him to report before learned Mahalir Fast Track Court (Sessions Cadre), Namakkal, on the first working day of every month at 10.30 a.m. till the disposal of the appeal. Seeking relaxation of such condition, the present petition has been filed.
3. Heard learned counsel for petitioner and learned Additional Public Prosecutor.
4. Considering the submissions made, this Court modifies the condition requiring the petitioner to appear before learned Mahalir Fast Track Court (Sessions Cadre), Namakkal, on the first working day of every month at 10.30 a.m. till the disposal of the appeal to one of requiring the petitioner to appear before such Court on the first working day at 10.30 a.m. once in three months viz., February, May,
August and November.
This petition is disposed of with the above direction.
