Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, Directing the 1st Respondent to settle the amount due to the husband of the Petitioner (Late) Thiru K.M.Vinayagam, the Contractor attached to the Adi Dravidar and Tribal Welfare Department for the works done by him as per the instructions of the District Adi Dravidar Welfare Officer Thiru K.Damodaran and also the Junior Engineer Thiru.R.T.Bhaskar based on the proposal dated 11.1.2012 and 30.5.2012 sent by the District Adi Dravidar Welfare Officer to the Government through the Director of Adi Dravidar Welfare within a reasonable period as may be fixed by this Honourable Court.

The grievances of the writ petitioner is that the husband of the writ petitioner Thiru.K.M.Vinayagam, was a Contractor under the Adi Dravidar Welfare Department from the year 1990 and carried out various works from 1990 till the date of his demise on 20.04.2015.

2.The amounts due to the husband of the writ petitioner has not been settled so far. In this regard, the writ petitioner setting out the details, submitted a representation to the first respondent on 19.09.2016, the said representation is yet to be considered by the 1st respondent.

3.This Court is of an opinion that the writ petitioner is a widow and now seeking settlement of the dues in respect of the works done by her husband, while serving as a contractor. Thus, the authorities competent have to verify the factual details and take a decision and pass orders.

4.In this view of the matter, the 1st respondent is directed to consider the representation submitted by the writ petitioner on 19.09.2016 and pass orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representation and all relevant documents, if any, along with the order passed in this writ petition. 5.With these directions, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
