Criminal Original Petitions filed under Section 482 of the Code of Criminal Procedure, praying to direct the Learned Judicial Magistrate, Ambattur, Thiruvallur District to take the cognizance on final report filed in Crime No.846 of 2013 and Crime No.825 of 2013 respectively, on the file of Inspector of Police, Ambattur Police Station, Chennai and complete the proceedings accordingly within the time stipulated by this Hon'ble Court.
For Petitioner : Mr.K.Balu For Respondent : Mr.S.Shanmugha Velayutham Public Prosecutor COMMON ORDER This petition is filed for a direction to the Learned Judicial Magistrate, Ambattur, Thiruvallur District to take the cognizance on final report filed in Crime No.846 of 2013 and Crime No.825 of 2013 respectively, on the file of Inspector of Police, Ambattur Police Station, Chennai and complete the proceedings accordingly within the time stipulated by this Court. 2.The petitioner is the Deputy President of Pattali Makkal Katchi and he served as Chairman of the Ambattur Municipality from the year 2006 - 2011. cases against him for political rivalry in the year 2013. The crux of the case in Crime No.846 of 2013 is that the petitioner threatened the defacto complainant with dire consequences and the crux of the case in Crime No. 825 of 2013 is that two known persons damaged the bus glasses and the Inspector of Police registered the case against the known persons. It is further alleged that the petitioner's name is not mentioned in the FIR. 3.It is submitted by the learned counsel appearing for the petitioner that the respondent, on completion of investigation has laid the charge sheet but the same was not taken on file till date. Hence, the petitioner came forward with these petitions.
4.The learned Public Prosecutor would submit that on completion of the investigation, charge sheet has already been filed and the same was not taken on file by the learned Judicial Magistrate, Ambattur, Thiruvallur District.
5.I have heard the learned counsel appearing for the petitioner as well as the learned Public Prosecutor. 6.In view of the submissions made on either side, this Court directs the learned Judicial Magistrate, Ambattur, Thiruvallur District to take the charge sheet on file within a period of two weeks from the date of receipt of a copy of this order and assign C.C.No. and complete the trial within a period of four months.
7.With the above directions, these Criminal Original Petitions are disposed of.
