Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying to permit the petitioner herein to amend the prayer in the above writ petition from the existing prayer, Therefore, for the reasons stated above, it is prayed that this Hon'ble Court may be pleased to issue a WRIT OF MANDAMUS or any other appropriate writ, order or direction in the nature of writ directing the respondents to pay enhanced 1/4
compensation Rs.18,061.60/- along with interest at 15% as per the Award No.05/85 dated 16.03.1985 from the date of acquisition of land till date, which is inclusive of amount mentioned in G.O.Ms.No.3 dated 21.01.2025 in line with the directions of the Division Bench of this Hon'ble Court at paragraph 20 in W.A.No.1317 of 2017 dated 01.09.2023, pursuant to the petitioner and his brother' land acquired to an extent of 4.46 acres in Survey No.583 in 105, Mornapalli Village, Hosur Taluk, Krishnagiri District in G.O.Ms.No.1339 Industries dated 20.09.1982 or any other relief that may deem fit and proper to the facts and circumstances of the case and thus render justice.
TO AS follows Therefore, for the reasons stated above, it is prayed that this Hon'ble Court may be pleased to issue a WRIT OF CERTIORARIFIED MANDAMUS or any other appropriate writ,order or direction in the nature of a writ calling for the records of the 2nd respondent in Na.ka.11200/1990/B2 dated 28.12.2023 and the consequential 3rd respondent's order in Na.Ka.358/2001/dated 04.01.2024 and quash the same as illegal and without jurisdiction, since the above impugned order of the 2nd and 3rd respondents are running contrary to the Transitional Provisions Division Bench of this Hon'ble Court in W.A.No.1317 of 2017 Paragraph 20 dated 01.09.2023; Consequently, direct the respondents herein to pay enhanced compensation Rs.18,061.60/- as per the Award No.05/85 dated 16.03.1985 along with interest at 15% p.a.
from the date of acquisition of land till date, which is inclusive of amount mentioned in G.O.Ms.No.3 dated 21.01.2025 for land acquired to an extent of 4.46 acres in Survey No.583 in 105, Mornapali Village, Hosur Taluk, Krishnagiri District in G.O.Ms.No.1339 Industries dated 20.09.1982 or any other order or further orders that may deem fit and proper in the facts and circumstances of the case and thus render justice.
