This criminal original petition has been filed to call for the records relating to Crime No.981 of 2009 on the file of Vadavalli Police Station, Coimbatore dated 15.12.2009 and quash the same.

2. Heard the learned counsel appearing for the petitioner, the learned Additional Public Prosecutor appearing for the 1st respondent and the learned counsel appearing for the 2nd respondent.

3. On the complaint lodged by one Kannan, the first respondent police have registered a case in Crime No.981 of 2009 under Sections 120-B, 465, 467, 468, 471 & 420 IPC against four accused, challenging which, S.Venkatachalapathy (A2) has filed the present quash petition to quash the FIR.

4. Mr.S.Sundararajan, Special Sub-Inspector, Vadavalli Police Station, Coimbatore District is present today.

5. Learned Additional Public Prosecutor submitted that S.Venkatachalapathy died on 24.05.2015 and he produced a copy of the death certificate. Since the petitioner / accused has died and charges against him abate, the investigation in the case is pending from 2009, on account of the pendency of this quash petition.

6. Under such circumstances, the first respondent police is directed to complete the investigation in Crime No.981 of 2009 as expeditiously as possible.
