The applicant seeks leave to institute the suit against the respondent before this Court. The applicant states that the suit is filed in respect of infringement of trademark and passing off, and that goods bearing the impugned mark are being commercially sold within the jurisdiction of this Court.

2. Upon considering the above submissions and on examining the draft plaint, it is evident that the cause of action has arisen at least partly within the jurisdiction of this Court. Therefore, A.No.2233 of 2022 is allowed by granting leave to the applicant to institute the suit against the respondent.
