Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondents 1 and 2 herein to grant permission and provide police protection to conduct the Vinayagar Chathurthi Festival from 17.09.2015 to 21.09.2015 in a grand manner by erecting statue of Vinayagar within the Drowpathi Amman Temple compound which is under control of the 3rd respondent herein at Palacode and taking the statue by procession through Palacode Bus stand upto Sri Gnanapillaiyar Koil and on return on the same way to Hogenakkal river for dropping the statue in water on the last day viz. 21.09.2015.

The petitioner made representations on 28.08.2015 to the respondent nos.2 & 3 seeking permission to conduct the Vinayagar Chathurthi Festival from 17.09.2015 to 21.09.2015 by erecting the statute of Vinayagar and thereafter, taking it on procession. The request includes a procession through Palacode Bus Stand upto Sri Gnanapillaiyar Koil.

2.The learned Additional Government Pleader, on instructions, submitted that the permission as sought for can be granted from https://hcservices.ecourts.gov.in/hcservices/

17.09.2015 to 19.09.2015 subject to the condition that the procession can be allowed to go on till Palacode Bus Stand. This submission has been made by taking into consideration the likelihood of law and order problem that might arise, apart from traffic congestion.

3.Considering the same, a direction is issued to the respondent nos.1 & 2 to grant permission to the petitioner from 17.09.2015 to 19.09.2015 subject to the condition that the petitioner can go on with the procession upto Palacode Bus Stand. 4.The Writ Petition is disposed of accordingly.
