ORDER
The petitioner has filed the above writ petition to issue a Writ of Mandamus directing the 2nd respondent to implement the proceedings of the 1st respondent dated 06.04.2017, within a time frame.
2. Mr.K.Govi Ganesan, learned counsel appearing for the petitioner submitted that the petitioner lodged a complaint against the 3rd respondent, who is a Stamp Vendor, for fabricating a Hiba, as if the entire properties were gifted to her during the year 2011 in order to defeat the right of her elder sister and the elder brother. The 2nd respondent conducted enquiry and in the said enquiry, the 3rd respondent admitted the misdeed committed by him. However, the 2nd respondent did not take any action against the 3rd respondent, hence, the petitioner sent a representation to the 1st respondent to take necessary action against the 3rd respondent. In these circumstances, the petitioner has filed the writ petition to direct the 2nd respondent to implement the proceedings dated 06.04.2017 passed by the 1st respondent.
3. Mr.E.Balamurugan, learned Additional Government Pleader,
taking notice for the respondents 1 and 2 submitted that the 2nd respondent may be directed to implement the proceedings dated 06.04.2017 passed by the 1st respondent.
4. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the 2nd respondent to implement the proceedings dated 06.04.2017 passed by the 1st respondent, if the same has not been challenged, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order. With this observation, the writ petition is disposed of. No costs.
