Global Conusmer Products Private Limited v. Golden Chocolates Private Limited

A.No.2726 of 2021 in C.S(Comm.Div.).No.565 of 2019 DR.G.JAYACHANDRAN, J.

This application is filed to receive the additional documents namely, the Chartered Accountant statement, which reflects the turn over of the plaintiff's company for the period from June 2019 to April 2021 and the expenditure incurred for the advertisement during the same period.

2. Counter is filed by the defendant stating that the data now tried to be introduced are subsequent to the suit and may not be necessary to decide the issue.

3. Since the matter relates to infringement of trademark, the prayer for passing off and to render account, the plaintiff to exercise its presence in the market, even after filing of the suit and wants its turn over to show his expenditure on advertisement, pending suit. Subject to proof, the additional documents may be received even though, it may be superfluous documents as contended by the defendants.

4. Post the matter on 13.09.2021 for affidavit of admission and denial.
