For Petitioners : Mr.G.Kadhiresan For R1 : Mr.A.Gopinath, Government Advocate (crl.side).
O R D E R
This petition has been filed seeking to quash the proceedings in Spl.SC.No.101 of 2024 on the file of Fast Track Mahila Court, Thiruvannamalai District, on the ground of compromise entered into between the petitioners and the second respondent.
2. Heard both sides and perused the materials placed before this Court.
3. It is brought to the notice of this Court by the learned Government Advocate (crl.side) that the petitioners are alleged to have committed a serious and heinous offence as against the second respondent. It is alleged that on 20.05.2023, after completing her work, the second respondent was given a lift by one Prabhu on his two-wheeler. While on their way to her hostel, they stopped near Raga City Layout Road, Kulakkarai. At that juncture, the petitioners, who were passing by on two motorcyles, allegedly scolded the second respondent using filthy language and attempted to sexually abuse her.
4. Considering the gravity and nature of the allegations, this Court is not inclined to quash the proceedings merely on the basis of a compromise entered into between the parties. The allegations involve serious questions of fact and are of public interest. Therefore, quashing the proceeding at this stage would not be appropriate. Accordingly, this Criminal Original Petition stands dismissed. The Trial Court is directed to proceed with the trial in Spl.SC.No.101 of 2024 and complete the same within a period of six months from the date of receipt of a copy of this order. Consequently, connected miscellaneous petitions are closed. 24.04.2025 : Yes/No Speaking/non-speaking order shk To
