ORDER

The order of transfer issued by the respondent in Proceedings No.02/Pa.2/STC (V)/Kanchi/2015, dated 31.8.2015, transferring the writ petitioner from Kalpakkam to Chengalpattu is under challenge in this writ petition.

On a perusal of the order of transfer impugned in this writ petition, the writ petitioner who is working as a Senior Driver in the Transport Corporation was transferred from Kalpakkam to Chengalpattu on administrative grounds. The administrative transfers are incidental to service, more so a condition of service. This Court cannot interfere with the order of administrative transfer in a routine manner, only in https://hcservices.ecourts.gov.in/hcservices/

the event of an order of transfer being issued by the incompetent authority or the allegations of mala fides are raised then the writ can be issued. In the case on hand, the writ petitioner is working as a Senior Driver in the Transport Corporation and he was transferred from Kalpakkam to Chengalpattu, within the same district and the distance is also meagre.

3. Under these circumstances, there is no reason to interfere with the order of transfer. This apart, the learned counsel appearing for the respondents states that pursuant to the impugned order of transfer the writ petitioner had joined duty in the above said post at Chengalpattu. In this view of the matter, no further adjudication on the ground raised in the writ petition is required to be under taken.

4. Accordingly, the writ petition stands dismissed. Consequently, connected miscellaneous petition is closed. However, no order as to costs.
