Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st to 3rd respondents to issue a Patta in favour of the petitioner herein based on the petitioner representation dated 15.09.2017 pertaining to the petition property situated at Door No.34, Rathinapuram, Thalakanacherry Village, Alandur Taluk, Kancheepuram District, Moovarasampet Main Road, Nanganallur, Chennai-600 114, comprised in Survey No.128 & 129, T.S.No.46 Block C, Ward 4, measuring an extent of 0.08 cents. Mr.E.Balamurugan, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner seeks for a mandamus directing the respondents to consider his representation dated 15.09.2017, wherein and whereby he sought for issuance of patta in his name in respect of the property situated at Door No.34, Rathinapuram, Thalakanacherry Village, Alandur Taluk, Kancheepuram District, Moovarasampet Main Road, Nanganallur, Chennai-600 114, comprised in Survey No.128 & 129, T.S.No.46 Block C, Ward 4, measuring an extent of 0.08 cents.

4. The grievance of the petitioner before this Court, is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the third respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the third respondent to consider the representation of the petitioner dated 15.09.2017 and pass orders on the same on merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as the rival claimants, if any. Such exercise shall be done by the third respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
