and Crl.M.P.No.6861 of 2023 A.D.JAGADISH CHANDIRA, J., Mr.John Sathyan, learned Senior Counsel appearing for the petitioners would submit that this Court by order dated 10.05.2023, had granted interim bail to the petitioners and also directed the petitioners to cooperate for the investigation and to identify all the properties in the name of the Company Siva Sakthi Benefit Fund Limited and the Directors of the Company and to furnish the details to the respondent. He further submitted that the petitioners were in custody for more than 72 days and after coming on interim bail, they also cooperating with the respondent for the investigation and have furnished the details of the properties, thereby, he would pray that the interim bail granted to the petitioners may be confirmed.

2. Learned Government Advocate appearing for the respondent/Police would submit that investigation is going on and there is a likelihood of the case being transferred to E.O.W.

Mr.Ashwin, learned counsel appearing for some of the intervenors submitted that there are several other properties which had been identified by the complainant, whereas, the petitioners have not given details about the same and the intervenors/defacto complainants are ready to furnish the details. He further submitted that direction may be issued to the respondent to take appropriate steps for attaching the properties.

4. Mr.T.Ananthasekar, learned counsel appearing for the intervenor submitted that petitioners have suppressed the availability of certain properties in their favour. He further submitted that before registration of F.I.R, the petitioners have transferred certain properties in favour of their relatives.

5. Heard the learned counsel appearing on either side and perused the materials available on record.

Considering the facts and circumstances of the case and the petitioners have been in custody for 72 days and it is also stated that there is a likelihood of the case being transferred to E.O.W., this Court is inclined to confirm the bail granted to the petitioners by order dated 10.05.2023. Accordingly, the bail granted to the petitioner in Crl.O.P.No.10432 of 2023 dated 10.05.2023 is made absolute. Consequently, connected miscellaneous petition is closed.

7. It is made clear that the petitioners shall furnish all the details with regard to the properties belonging to Siva Sakthi Benefit Fund Limited and the Directors of the Company and the respondent shall take appropriate steps in accordance with law to attach those properties. The petitioners shall continue to comply with the conditions imposed in the order dated 10.05.2023.
