ORDER
This Writ Petition has been filed seeking for a direction to the Respondent Nos. 1 to 3 to constitute the Standing Committee under Witness Protection Scheme-2018 and to deal with the Petitioner's application dated 18.04.2026 in accordance with law within a time frame. 2.It is stated that the 5th Respondent created a forged document (Will dated April 20, 2006) for the property belonging to the Petitioner. Hence, the petitioner filed a Civil Suit in O.S.No.213 of 2009, praying to declare the Will dated April 20, 2006 is forged one and also sought consequential relief. The said Suit was decreed on July 29, 2019 in favour of the petitioner. Further, the petitioner filed a Criminal Case against the 5th respondent and the same was taken on file as C.C.No.119 of 2019 and the same was ended in acquittal. The
Petitioner as a victim filed an Appeal in Criminal Appeal No.72 of 2025 and the same is pending before learned Additional District Judge (FTC), Villupuram. In the Appeal, the petitioner has filed two applications i.e., recall application as well as application for marking additional documents. In these circumstances, 5th respondent started to threaten the petitioner. On March 28, 2026, 5th petitioner broke the main gate lock of the property and removed the petitioner's name board. The petitioner gave complaint before the 4th Respondent and the 4th Respondent gave CSR No.158 of 2016. Hence, the Petitioner apprehends that 5th Respondent will cause injury to him. Hence this petition. 3.
The learned Counsel appearing for the Petitioner submitted that the Petitioner is a witness in the criminal appeal proceedings and an application has been filed to recall and examine the Petitioner as P.W.1. He further submitted that the Petitioner is being threatened in connection with the said proceedings and therefore, the Petitioner submitted a representation/application to the authorities concerned on 18.04.2026 seeking necessary action. 4.The learned Counsel further submitted that the Criminal Appeal No.72 of 2025 is now posted before the learned Additional District Judge (FTC), Villupuram on 08.06.2026 and unless appropriate orders are passed on the Petitioner's representation, the Petitioner would be put to serious prejudice. Therefore, he prayed for issuance of appropriate directions in the above regard.
5.Learned Government Advocate appearing for the Respondents submitted that he has no objection for issuance of suitable directions. 6.Heard the learned Counsel on both sides and perused the materials available on record.
7.Considering the facts and circumstances of the case and taking note of the fact that the Petitioner's application dated 18.04.2026 is pending, this Court is inclined to direct the Respondent No.1 to consider the Petitioner's application as referred to supra and pass appropriate orders on merits, after ascertaining the factual situation and the petition averments in accordance with law and to pass appropriate order, as expeditiously as possible, preferably before the next hearing date i.e., June 8, 2026.
8.With the above directions, the writ petition stands allowed to the limited extent indicated above. No costs.
