O R D E R

The petitioners have filed this writ petition seeking issuance of Writ of Mandamus directing the respondents 1 to 3 to provide underground drainage connection to the petitioners' DTCP approved layout situated in S.F.Nos.33/1B and 33/2B, Villarasampatti "B" Village, Erode Taluk, Erode District based on the petitioners' representation dated 02.02.2026.

2.The learned counsel appearing for the petitioners submitted that the petitioners are the absolute owners of the land in S.F.Nos.33/1B and 33/2B, situated at Ward No.10, Villarasampatti "B" Village, Erode Taluk, Erode District, measuring an extent of 1.00 acre and with an intention to develop the said land into a residential layout, the petitioners submitted application on 04.10.2023 before the competent Authority under the Town and Country Planning Act, 1971 and the same was duly approved on 21.11.2023. The learned counsel 2/4

further submitted that the petitioners adhered to all statutory procedures and executed necessary settlement deeds in favour of the Corporation to facilitate provision of infrastructure such as roads, water supply and underground drainage and thereafter submitted representation dated 02.02.2026 to the first respondent seeking provision of underground drainage connection from the approved layout to the existing municipal drainage system, however, there is no response.

3.The learned Government Counsel appearing for the second respondent submitted that the petitioners' request for underground drainage connection is pending consideration before the Government. 4.Considering the submission made by the learned Government Counsel appearing for the second respondent, this Court, without expressing any opinion on the merits of the case, directs the second respondent to consider the petitioners' representation dated 02.02.2026, on merits and in accordance with law and to pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.
