Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, to direct the respondent to approve and permit the petitioner college to fill up 4 posts of non-teaching staff, viz., Watchman-2, Gardner-1 and Sweeper-1 in the sanctioned vacancies in the petitioner College in the light of the order passed in W.P.Nos.6679 & 6680 of 2016, WA(MD)Nos.461 & 462 of 2016 and SLP.No.22766 of 2017 based on the proposal given by the petitioner college dated 29.04.2019.

ORDER

This Writ Petition has been filed, seeking for issuance of a Writ of Mandamus, to direct the respondent to grant approval and permission to the petitioner College to fill 4 posts of nonteaching staff, viz., Watchman-2, Gardner-1 and Sweeper-1 in the sanctioned vacancies in the petitioner College.

According to the petitioner College, in regard to the filling up of 8 posts of non teaching staff as mentioned above, a proposal has already been sent to the respondent on 29.04.2019 and the same has been pending without any progress. The petitioner College has been sanctioned total 23 posts of nonteaching staff as per proceedings of the respondent dated https://hcservices.ecourts.gov.in/hcservices/

23.11.1973 and out of the same, since 4 posts have fallen vacant due to retirement and death of erstwhile staff, the petitioner College has decided to fill up the same to run the institution. Though the proposal has been sent on 29.04.2019, no decision has been taken by the respondent on the said proposal forwarded by the petitioner College. Therefore, the petitioner is before this Court, seeking for the issuance of Writ of Mandamus as prayed for.

When the matter is taken up, Mr.V.Kathirvel, learned Special Government Pleader took notice and appeared on behalf of the respondent and would submit that a direction may be issued to the respondent to take a decision on the proposal sent by the petitioner College, within a time stipulated by this Court.

4. In view of the limited prayer sought for, this Writ Petition is being disposed of with the following direction: The respondent is directed to pass orders on the proposal submitted by the petitioner College on 29.4.2019 towards filling up of 4 posts of non-teaching staff, viz., Watchman-2, Gardner-1 and Sweeper-1, within a period of eight weeks from the date of receipt of a copy of this order and any decision taken in this regard, shall be communicated to the petitioner College forthwith by the respondent. No costs.
