Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, calling for the proceedings of the respondent in Memo No.3829/2012/A dated 18.2.2013 and quash the same.

ORDER

This writ petition is directed against the impugned charge memo dated 18.2.2013 issued with ten articles of charges.

2. Learned counsel for the petitioner submitted that the sum and substance of the entire charges would go to show that the petitioner had not maintained the registers properly and also failed to get prior approval for issuance of cheques for more than ten thousand rupees. On receipt of the said charge memo, the petitioner, refuting all the allegations found in the charge memo, submitted his detailed explanation and thereafter finding the said explanation not satisfactory, appointed an enquiry officer and the enquiry officer also, on completion of the enquiry, submitted his report on 24.10.2013 holding the charge nos.2,3 & 7 are partly proved and the other charges failed. After receipt of a copy of the enquiry report, the petitioner gave his further written representation on 4.6.2014. In spite of the lapse of almost three years, the respondent has not come forward to pass final orders, as a result the petitioner is made to lose all avenues of promotion.

3. The learned Additional Government Pleader for the respondent sought time to file counter.

4. But this Court is not inclined to grant any time, in view of the submission of the enquiry report and the further representation made by the petitioner. Therefore, the District Collector, Thiruvannamalai Town Panchayats Division is hereby directed to pass final orders, on merits and in accordance with law, on the pending enquiry initiated against the petitioner within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. Consequently, W.M.P.Nos.29429 & 29430 of 2017 are closed. No costs.
