Respondent Prayer: Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondent to fix the petitioner in the time scale of pay w.e.f 22.07.2010 at Rs.9300-34800-GP-4500/- and thereafter at Rs.36,200-114800/- as per G.O. Ms.No. 303, dated 11.10.2017 w.e.f. 01.10.2017 by considering the representation made by the petitioner on 13.01.2020. For Petitioner : Mr.P.Ganesan for M/s. C.S. ORDER

The relief sought for in the writ petition is for a direction to the respondent to revise the time scale of pay of the petitioner as per G.O. Ms.No. 303, dated 11.10.2017 w.e.f. 01.10.2017 by considering the representation made by the petitioner on 13.01.2020.

The learned counsel for the petitioner has submitted that the petitioner has worked as General Manager (Business) under the respondent society and he has been working on consolidated pay of Rs.15,000/- per month for the past nine years, now the said consolidated pay has been raised to Rs.30,000/-. The learned counsel for the petitioner has further submitted that as per G.O.Ms.No.303 dated 11.10.2017 and the circular issued by the respondent/Registrar of Cooperative Societies, dated 06.01.2010, the petitioner is entitled for revision of scale of of at Rs.9300-3480-GP-4500/- on completion of six months and the same has to be raised to Rs.36,200-114800/- w.e.f 01.10.2017. The petitioner has made several representations, lastly on https://hcservices.ecourts.gov.in/hcservices/

26.02.2020 to the respondent, since no action has been taken, he filed the present writ petition.

The learned counsel appearing for the petitioner has relied upon the order of this Court made in W.P.No. 4773 of 2020, dated 26.02.2020 and submitted that the similarly placed person namely Ramesh has filed the said writ petition before this Court and obtained orders for granting benefits of the revised scale of as per G.O.Ms.No.303 dated 11.10.2017. In view of the said order, the petitioner is also entitled to the similar benefits.

4. The learned Government Advocate, on instructions would submit that the representation submitted by the petitioner is still pending on the file of the respondent and the same will be considered in accordance with law and orders will be passed,within a time frame as fixed by this Court.

Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsels appearing for the parties concerned this Court, without expressing any opinion and without going into merits of the case, is inclined to direct the respondent to consider the representation dated 13.01.2020 submitted by the petitioner and pass appropriate orders, in accordance with law, as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition is disposed of. No costs.
