Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to consider and pass orders on the representation of the petitioner dated 01.09.2015 for requesting the respondent to select the petitioner as teacher under the ST quota as per Tamil Nadu Teachers Eligibility Test [TNTET] Exam 2013, Roll No.13TE34214438 [C.V.No.E2951] in the existing vacancies.

By consent, the writ petition is taken up for final disposal. The petitioner would state that his educational qualification is B.A., B.Ed., and he had applied for appointment to the post of Teachers in Class No.6 to 10 and his Roll Number is 13TE34214438 [C.V.No.E2951] and he has attended the written examination on 18.08.2013 and secured 90 marks and subsequently called for certificate verification on 23.01.2014 and however, he has produced a Community Certificate stating that he belongs to MBC community. The petitioner would state that his father had requested the Revenue Divisional Officer to issue Community Certificate for his sons/the petitioner and his brother as they belong ot Kurumans [ST] Community and since the said request was rejected, the petitioner's father had filed WP.No.9512/2015 and this Court, vide order dated 13.07.

2015 has set aside the order of the Revenue Divisional Officer, Dharmapuri and directed the RDO to issue necessary Community Certificate to the sons of the petitioner therein which included the petitioner herein. https://hcservices.ecourts.gov.

The petitioner was also issued with a Community Certificate by the Revenue Divisional Officer, Dharmapuri dated 04.08.2015 in Certificate No.381111. The grievance now expressed by the petitioner herein is that had the Community Certificate been made available to him at the time of certificate verification, he would have been selected and sought information under the Right to Information Act,2005 and got details that 19 posts are yet to be filled up and therefore, submitted a representation dated 01.09.2015 to the respondents praying for accommodation in any one of the 19 vacancies and since no orders have been passed, the petitioner came forward to file this writ petition. Heard the learned counsel for the petitioner and Mr.S.Gunasekaran, learned Government Advocate who accepts notice on behalf of the respondent.

Though the petitioner has sought for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the respondent to consider and dispose of the petitioner's representation dated 01.09.2015 on merits and in accordance with law and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
