O R D E R

This petition has been filed to direct the respondents not to harass the petitioner and his family members in the guise of enquiry without following due process of law.

2. Learned counsel for the petitioner submitted that a complaint was lodged against this petitioner by his wife, Fathimuthu Johara Banu @ Vaishnavi and based on the said complaint, the second respondent police is frequently calling the petitioner and harassing him.

3. Learned Additional Public Prosecutor submitted that only for the purpose of enquiry, based on the complaint lodged by the petitioner's wife, the petitioner is called for the enqiry and he has no intention to harass the petitioner and only to avoid the enquiry, the present petition has been filed by the petitioner.

4. Considering the submissions made on either side, this Court is constrained to pass the following order:- (i) The petitioner is directed to co-operate with the enquiry.

(ii) The 2nd respondent police is directed to conduct the enquiry in accordance with law, without harassing the petitioner and his family members.

5. This criminal original petition is disposed of accordingly.
