ORDER

The petitioners apprehend arrest for the alleged offence under Sections 21(1) of Mines and Minerals Act, 1957 and Sections 303(2), 326(a) of BNS, 2023 in Crime No.60 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners was found in illegal transportation of 1 unit of river sand. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocents and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners got one similar previous case. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Taking into consideration the fact that the petitioners have similar previous case, this Court is of the firm view that the petitioners does not deserve anticipatory bail.
