C O M M O N O R D E R These Writ Petitions are filed to quash the Notification issued under Section 3A and the Declaration issued under Section 3D of the National Highways Act, 1956 and also to direct the respondents to issue a fresh Notification under Section 3A and Declaration under Section 3D of the National Highways Act, 1956, respectively.

Heard the learned counsel for the petitioners; learned Central Government Standing Counsel for the first respondent; learned Standing Counsel for the second respondent; learned Additional Government Pleader for the respondents 3 to 7 and perused the materials available on record. 3.

Though challenge has been made to the Notification issued under Section 3A of the National Highways Authority of India for the acquisition proceedings, it is the contention of the learned counsel for the petitioners that admittedly the land acquired was 'Grama Natham' and the petitioners are in the possession of the property. Therefore, it is submitted that the petitioner's representation dated 18.07.2023 is considered on merits. 4/8

It is also brought to the notice of this Court by the learned counsel for the petitioners that National Highways Authority of India has also addressed a communication dated 19.06.2023 in NHAI/11013/2/2022/PIU,Chennai/1135 to the Competent Authority and Special District Revenue Officer (I.A), National Highways, Tiruvallur, for taking necessary action after due verification for payment of compensation. The said communication makes it clear that the petitioners are having possession over the property on the basis of the Thoraya Patta already issued to him.

In such view of the matter, let the Competent Authority and Special District Revenue Officer / 4th respondent is directed to consider the representation of the petitioners dated 18.07.2023 and pass orders on merits for payment of compensation in accordance with law, within a period of two months from the date of receipt of a copy of this order. 5/8

With the above direction, these writ petitions are disposed of. No costs.
