PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records in connection with the impugned FIR in Cr.No.10/2017 under Sections 409, 420, 468 and 477A of IPC registered by the 1st respondent/complainant charging the petitioner and quash the same.

O R D E R

The petitioner is before this Court with the prayer to call for the records in connection with the impugned FIR in Cr.No.10/2017 under Sections 409, 420, 468 and 477A of IPC registered by the 1st respondent/complainant charging the petitioner and quash the same.

2.The learned Additional Public Prosecutor would submit that the 1st respondent after registering the FIR in Crime No.10 of 2017, conducted investigation and filed the final report before the Judicial Magistrate No.II, Dharmapuri as early as on 10.12.2019 and it is pending for taking cognizance. Therefore, the prayer as such sought for by the petitioner has become infructuous.

3.In view of the submission made by the learned Additional Public Prosecutor, the petition become devoid of merits and the Judicial Magistrate No.II, Dharmapuri is directed to take cognizance of the final report filed in connection with Crime No.10 of 2017, within a period of four weeks from the date of receipt of a copy of this order.

4.With the above direction, the Criminal Original Petition is dismissed as Infructuous.
