PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue directions to the respondents particularly the inspector of Police, Mailam Police Station, Tindivanam Taluk the 2nd respondent herein to alter the FIR in Crime No.1501/2020 for the alleged offence 174 of Cr.P.C., pending on the file of the 2nd respondent into 302 of the Indian Penal Code and other relevant Sections of law and investigate the crime and deal with the persons referred in the complaint in accordance with law.

O R D E R

This Criminal Original Petition has been filed to alter the FIR in Crime No.1501/2020, for the alleged offence u/s. 174 of Cr.P.C., to 302 of IPC, pending on the file of the 2nd respondent Police.

2.The learned Additional Public Prosecutor on instructions submitted that the investigation has been completed and a Final Report has been filed before the learned Judicial Magistrate No.II, Tindivanam on 31.10.2020, for an offence under https://hcservices.ecourts.gov.in/hcservices/

Section 279 and 304 (A) of IPC. The learned Additional Public Prosecutor further submitted that the Final Report is yet to be taken on file by the concerned Court.

3.The submissions of the learned Additional Public Prosecutor is recorded and there shall be a direction to the learned Judicial Magistrate No.II, Tindivanam, to act upon the Final Report submitted by the respondent Police, within a period of one month from the date of receipt of copy of this order. This Criminal Original Petition is disposed of accordingly.
