the sum of Rs.9,18,000/- (Rupees Nine Lakh Eighteen Thousand Only) together with the accrued interest in all amounting to Rs.10,20,052/- (Rupees Ten Lakhs Twenty Thousand and Fifty Two Only) lying in the savings bank account no. 50362331971 with the 3rd respondent bank maintained by the husband Thiru.S.Narayanan in favour of the petitioner in light of succession certificate granted by order dated 08.08.2024 passed in O.P.No. 128 of 2023 on the file of the Principal Sub-Court, Thiruchirapalli and to pass such other or further orders. ORDER
The Writ Petition is filed for a mandamus directing the 3rd respondent to release and disburse a sum of Rs.9,18,000/- with accrued interest in all amounts to Rs.10,20,052/- lying to the credit of the savings bank account No.503623311971 maintained by the 3rd respondent bank, in the name of the husband of the petitioner - (Late) Thiru S.Narayanan.
2. Upon hearing the learned counsel for the petitioner and perusing the affidavit filed in support of the Writ Petition, it can be seen that the grievance of
the petitioner is that the petitioner's husband was maintaining the said account. He died on 27.04.2022 and thereafter, the petitioner had approached the jurisdictional Civil Court and obtained succession certificate in O.P.No.128 of 2023. Even thereafter, the amounts are not realised. As a matter of fact, the legal heirship certificate dated 30.05.2025 is also produced.
3. When the matter came up for hearing, Mr.V.Kalyanaraman, the learned counsel took notice on behalf of the Bank. He would submit that there was no nomination on account thereof, the amount is not being released by the Bank.
4. Be that as it may, when the petitioner has already obtained succession certificate, there can be no impediment whatsoever in releasing the amount to the petitioner.
5. In view thereof, this Writ Petition is disposed of on the following terms, (i) The 3rd respondent - Bank is directed to release the sum of Rs.10,20,052/- lying in the savings account No.50362331971 to the petitioner,
by considering the petitioner's representation dated 30.11.2024; (ii) The orders shall be passed and the amount shall be released within a period of four weeks from the date of receipt of the web copy of the order, without waiting for the certified copy of this order; (iii) No costs.
