This application has been filed to implead the proposed respondent as fifth respondent in A.No.1667 of 2020 in C.S.No.46 of 2019. 2.

The application in A.No.1667 of 2020 had been originally filed to direct the respondents 2 and 3 to furnish security to a sum of Rs.1,87,00,000/-. During the course of argument, this Court is also directed the applicant to implead the proposed party since he is already a second charge holder over the subject property for the production.

Having regard to the fact that the proposed party is a second charge holder over the subject property, any order passed in Application No.1667 of 2020 will have a direct impact on him and therefore, without his presence, the application to furnish security cannot be adjudicated. Since no prejudice would be caused to the proposed party by ordering the impleading application, the impleading application is allowed.
