Learned Counsel for the Petitioner submits that the Petitioner in C.M.P.No.11841 of 2021 in S.A.No.228 of 2009 is the person who had purchased the property after the judgment in the first Appeal. Therefore, pending Second Appeal, She was impleaded as Respondent-2 in S.A.No.229 of 2009 which is against O.S.No.5249 of 2000 on the file of the learned VI Assistant Judge, City Civil Court Chennai. O.S.No.5249 of 2000 was filed by the Husband seeking injunction. O.S.No.2393 of 1993 was filed by the Wife seeking possession.

2. Both the suits were tried together and by common judgment, the suits were disposed of. S.A.No.229 of 2009 which arise out of judgment against O.S.No.5249 of 2000. A.S.No.711 of 2005 against the judgment in O.S.No.5249 of 2000. S.A.No.228 of 2009 which arise out of judgment against O.S.No.2393 of 1993. A.S.No.710 of 2005 against the judgment in O.S.No.2393 of 1993. In S.A.No.229 of 2009, the purchaser had already been 1/3

impleaded whereas in S.A.No.228 of 2009, the purchaser seeks to implead herself as Respondent-2.

3. The learned Counsel for the Appellant present in Court does not have objection.

4. Accordingly, C.M.P.No.11841 of 2021 is allowed.

5. Registry is directed to carry out amendment in the cause title.

6. Post both the Appeals by next week.
